PURCHASES OF CLASS PLANS & MEMBERSHIPS

CLASS PLANS

All single classes, series of classes, and packages of classes are non-refundable and non-transferable; there are no exceptions.

MEMBERSHIPS

Our memberships come with a 1-Month Minimum Commitment (Minimum Term 1 month), 6-Month Minimum Commitment (Minimum Term 6 months) and 12-Month Minimum Commitment (Minimum Term 12 months).

All payments made for memberships are non-refundable and non-transferable; there are no exceptions.

Our memberships are available for ALL STUDIOS access or for SINGLE STUDIO access (Central ONLY, or Art Piece CWB ONLY).

CANCELLATION BEFORE THE END OF THE MINIMUM TERM

We understand that circumstances change and that you may need to cancel a membership before the expiry of its Minimum Term.

Memberships may be canceled at any time by giving us notice by email and making a lump sum payment equal to 50 percent of the remaining Monthly Recurring Payments of the Minimum Term which you would have paid during the remaining period of your membership.

For example, if you subscribe to a 6-Month Unlimited Membership at $1,990/month and you need to cancel it after 45 days (2nd month):

• Remaining months in the Minimum Term: 4 Months

• Remaining Monthly Recurring Payments of the Minimum Term = 4 x $1,990 = $7,960

• Lump sum to pay (50%) = $7,960 x 50% = $3,880

ADDITIONAL T&Cs APPLYING TO 6-MONTH MINIMUM COMMITMENT AND 12-MONTH MINIMUM COMMITMENT MEMBERSHIPS
(purchased on June 5th, 2023 onwards)

At the end of the Minimum Term, your membership will automatically continue on a month-to-month basis.
This means that as long as you stay with us with your current membership, you will pay the same monthly price (no price increase) and you will be able to cancel at anytime thereafter (please see details below).

CANCELLATION AFTER THE END OF THE MINIMUM TERM

Cancel at any time.
Please submit the Termination Form at least 15 days before the end of your current month and we will terminate the memberships before the next autopay.

SPECIAL PROMOTIONS & OFFERS

IKIGAI may offer from time to time various “Special Offers and Promotions”, or “Events” which may have limited availability and may come with additional conditions or privileges. All IKIGAI purchase terms and conditions apply unless otherwise stated.

EXPIRATION DATES OF CLASS PLANS, PACKAGES AND SERIES

All single classes, series of classes, packages of classes or monthly recurring classes have a use-by or an expiration date. You purchase access to IKIGAI to utilize your classes for the allotted time period.

PAYMENTS FEES, RECURRING PAYMENTS, RENEWAL FEES

A Client’s obligation of payment: No Client shall be relieved of the obligation to make payments for agreed-upon monthly committed plans, class programs, recurring packages, recurring monthly programs, renewals, or single classes as a result of failure to utilize IKIGAI or its classes or class credits thereof within allotted timeframes. There are no refunds of monthly payments, service fees, recurring payments or renewal fees.

METHOD OF PAYMENT

INITIAL PAYMENTS
Initial payments for classes and programs at the Studio may be made by cash, PAYME, FPS or credit card only. There are no refunds. Initial payments via IKIGAI App or ikigai.hk website are by credit card via our third party administered software provider. In order to conveniently make payments through our website and app you acknowledge and agree to your authorization of IKIGAI, and our third party administered software provider, to store and maintain your encrypted information for this purpose. You must have an IKIGAI Client account and be in “good standing” in order to purchase, renew or book/schedule your program/classes/class credits.

RECURRING PAYMENTS & AUTO RENEWALS
All monthly recurring plans and class package auto renewals are via EFT (Electronic Funds Transfer) through credit card or checking account bank draft only via our third party administered software provider.

Non-auto renewal programs may be renewed in the studio at IKIGAI by cash, PAYME, FPS or credit card or online at ikigai.hk via your account saved valid payment methods in your account.

Furthermore, you authorize the same methods of payments for any and all additional fees or service charges, including but not limited to; late payment fees, upcharges for services, single class add-ons, guest fees etc.

COLLECTION OF PAYMENTS AND FEES
All Clients and Guests agree that upon failure to pay any agreed-upon fees subject but not limited to; renewals and recurring payments, auto-renewal packages, services charges, late cancellation fees, late payment fees, no show fees, upcharges for services, single class add-ons, guest fees etc. in a timely fashion an in accordance with any agreements and/or schedules is a violation of policy. All Clients and Guests agree to pay any costs of collection of unpaid fees or services charges including but not limited to; reasonable attorney fees, collection fees or court costs associated with the attempt to collect, or the actual collection of, the unpaid fees and charges owed or due by the Client or Guest.

BOOKING CLASSES
You may book classes 2 weeks ahead of schedule. You must have an active class series, package, plan or credits available and in good standing in order to pre-book classes.

For all pricing options purchased via IKIGAI, you can book directly online on our website but we recommend you download the IKIGAI Wellness App (iOS / Android) for a more seamless and faster booking experience.

Please note that for CWB ONLY pricing options, purchases, bookings and cancellations shall be made via the Art Piece system. Please contact the Art Piece team for any assistance on +852 9538 1727.

Classes have limited spaces available. Once the class has started, we cannot allow anyone to enter the Studio and disrupt the flow of the class. So, we ask that you are physically in Studio no later than 5 minutes prior to the start of your class. Otherwise, you may be considered a “late cancel” and your spot may be released to a waitlisted Client. Any waitlisted Client that receives notification of upgrade to class booked Client, must also be Studio to take advantage of that space otherwise it will defer to the next available in Studio waitlisted Client etc.

WAITLIST POLICY
If a class you want to book is full, we recommend that you put yourself on the waitlist. Just click on the class you want and choose waitlist when prompted. It will tell you if the waitlist space is available or full as well. If a space opens, you will be added to that class and receive an email confirmation.

From there, there are two scenarios:

1/ Confirmation email received more than 6 hours before the class:

Once you receive the confirmation; all class policies now apply to your booking. If you do not show up or cancel 6 hours ahead of time, you may be charged a “no show or late cancel fee”.

2/ Confirmation email received less than 6 hours before the class:

Because of the late notice, we allow Client to cancel their booking without any charge. This can be done by emailing us on hello@ikigai.hk or via Whatsapp on +852 9013 3701.

YOUR RIGHT TO CANCEL YOUR SCHEDULED OR RESERVED CLASSES
Clients may cancel classes without charge or loss of class credit provided it is within IKIGAI’s cancellation policy of 6 hours or more prior to the class reserved. For any classes canceled with less than 6 hours’ notice, you will forfeit the class or class credit and your account will be deducted or charged against your class package or monthly plan or a single class payment may be due if you have run out of classes or class credits at the time of cancellation.

We have two convenient ways to cancel:

1/ Cancel online: Go to our website www.ikigai.hk or open the IKIGAI Wellness App, log in to your account and cancel or reschedule from there.

2/ Cancel by text: If you’re in an unexpected situation, running late, or cannot cancel online, you can cancel over the phone by calling or texting +852 9013 3701. Just leave a message with your name, the date, time and details of the class reservation you need to cancel.

No-shows and late cancellations are charged as if attended.

For Unlimited Memberships, if there are three (3) No-Shows or Late Cancellations within a period of 30 days, the Client’s account will be suspended and he/she will be unable to book classes for 1 week. The suspension also applies to walk-ins.

(The classes that have been booked prior to a suspension will not be canceled, and the Client will still be able to attend them)

If a Client has signed up for a class but arrives too late and is not allowed into the classroom, this will count as a no-show on your account.

It is also very important that the Client makes sure to check in for the class you attend upon arrival. Please email us at any moment if you have missed doing it or in case of any doubt.

All Clients must adhere to class etiquette and respect the teachers and other students by arriving before the class start time.

Arrival Time For Class
Studio rooms are open 10 minutes before class begins. We encourage you to arrive no less than 5 minutes before your scheduled class to give yourself adequate time to check-in and get settled before class starts. In order to respect the teacher and other students, late arrivals will not be allowed into class. Please ensure that you are on time for class.

IKIGAI reserves the right to prevent students from entering the classroom if they have missed the class start time.

IKIGAI’S RIGHT TO CANCEL CLASSES
IKIGAI reserves the right to cancel classes based on low attendance, registration or enrollment. Class times and schedules may deviate or vary from the current schedule without notice. We reserve the right to remove classes temporarily or permanently from any time slot, or day within the schedule without notice.

REVOCATION OR SUSPENSION OF CLASS CREDIT OR PRIVILEGES
It is at the sole discretion of the Studio (IKIGAI) and thus it reserves the right to suspend, cancel or revoke your privileges, or credits at any time without refund if your behavior is deemed to be subject but not limited to; objectionable, unsafe, offensive, disturbing, inappropriate, lewd, amoral, discriminatory, or a general nuisance to any Clients, Guests or Staff Members. Additionally, the Studio (IKIGAI) reserves the right to suspend, cancel or revoke your privileges, or credits at any time without refund if you pose or are deemed likely to pose a health or safety risk to others at the Studio due to your health condition or personal hygiene etc.

Your classes may be temporarily or permanently suspended, cancelled or revoked at the sole discretion of the Studio (IKIGAI) for violation of IKIGAI “Good” Client Rules and Regulations under the terms and conditions of your enrollment at IKIGAI Studios.

LOCKERS
Lockers may not be used overnight. Members who do so are liable to find that the lockers are opened and locker contents removed. Removal of such items is strictly at the member’s own risk.

STUDIO PRIVILEGES
As a condition of enrollment, all Clients agree to abide by all Studio Rules, Regulations and Policies of IKIGAI. These rules and regulations are available at the time of your enrollment in Studio and on our website at ikigai.hk.

Clients agree that class/class credits or use of Studio privileges are not transferable and are not allowed to be utilized by unauthorized persons. IKIGAI (the Studio) at its sole discretion may temporarily or permanently suspend or revoke Studio privileges, classes or class credits for violation of this rule.

CLIENT/GUEST CONDUCT
The Client/Guest is responsible for his/her participation and use of all equipment, accessories and performance while attending the Studio, performing classes or sessions and shall be responsible for any damage or personal injury caused by his/her guest, co-client or his/herself or to any equipment, accessories, Studio facilities.

PERSONAL PROPERTY AND OTHER VALUABLES
All Clients/Guests agree and acknowledge that they have been urged to avoid bringing valuables into the Studio facility, or outside events and that IKIGAI shall not be liable for the loss, theft, or damage to any personal property or valuables, including items left in lockers, restrooms, training area, outdoor event space or anywhere else in the Facility. Clients/Guests cubbies or lockers are providers for your convenient use of such cubbies or lockers and the sole acknowledgment that no portion of any fees paid by you is in consideration for the safeguarding of valuables.

All Clients and Guests understand the risk of injury from physical exercise or training activities and using any equipment may be significant, including the potential for injury or death. They knowingly and freely assume all such risks, both unknown and known.

All Clients and Guests acknowledge that they may engage in both privately supervised, group supervised or unsupervised activity and they assume all risks of using equipment, movement or exercise routines or props with or without staff present. In addition, they acknowledge that the business may include outdoor activities, which may present risks such as slippery surfaces, uneven surfaces, loose rocks/gravel, unseen landscaping issues or more.

All Clients and Guests hereby release, indemnify and hold harmless HOUSE OF IKIGAI LIMITED, it’s partners, it’s employees and contractors, and the owners of this business or any other business that may be associated with this company, with respect to any and all injury, disability, death, loss or damage to person or property that may arise out of connection with this business or any use of its products, services or classes. This also includes any negligence associated with the presence of or transmission of any bacteria, viruses, or infectious diseases.

All Clients and Guests expressly agree that this release is intended to be as broad and inclusive as permitted by applicable law and if a portion of this release is held invalid the balance shall remain in full force and effect. This release shall apply to their heirs, assigns, personal representatives and any other next of kin. They understand that this business is relying on this release in agreeing to enter into this agreement.

All Clients and Guests have read the release of liability and assumptions of risk agreement and fully understand its terms and that they have given up substantial rights by signing it and they sign it freely and voluntarily without inducement.

All Clients and Guests agree that the use of the Studio facility or it's classes or any other activity organized by the Company, does not constitute a form of medical treatment and will not necessarily result in a medical benefit to the Client/Guest. Prior to commencing a physical exercise program, the Client/Guest should consult his/her physician. The Studio will make no evaluation or recommendation as to whether the Client or the Guests are medically fit for any exercise activities. The Client/Guest represents that he/she is in good health and suffers no physical impairments or limitations which renders the use of the Studio facility or performance of activities in its classes, workouts or programs unduly dangerous.

All Clients and Guests also understand and agree that:

Any minors can only be trained with the signed permission of a parent/guardian, and it is acknowledged that no-fault/negligence can arise against the company when a minor is a client other than what is required in the accepted standard of care for an adult.

Once the payment for classes is made and they have agreed to a set number of sessions unless otherwise agreed upon they must pay the full amount for any package regardless of the number of sessions taken in that package.

Payment installments and methods can vary according to any individual agreement. However, IKIGAI reserves the right to charge them in full for any entire agreed package.

IKIGAI reserves the right to cancel any package with no refund given.

If they receive more training sessions than originally agreed upon, in the absence of a new agreement, IKIGAI reserves the right to charge them at the highest session rate.

If they are late in paying their fees, IKIGAI reserves the right to charge them 25% per annum interest on the outstanding money and a HK$300 administrative fee for every week that payment is overdue. Unless otherwise agreed, being late means full payment is not received within 7 days of written notification of overdue fees. Should IKIGAI need to outsource any debt recovery to a third party, they will be responsible for any fees incurred thereafter.

IKIGAI reserves the right to charge them for any booked session that is canceled with less than 6 hours' notice.

IKIGAI reserves the right to use any before and after images within promotional materials both web-based and offline, and they agree that these images and any written testimonials they may provide are only for the use of IKIGAI.

IKIGAI intends to use their personal data (name, residential address, telephone number, and email address) collected from them for direct marketing of its services and products.

These Terms and Conditions represent an agreement between All Clients and Guests and IKIGAI. They are deemed to be accepted upon receipt of this document via email, via IKIGAI’s booking and payment platform, or upon payment of a deposit, without a signature unless otherwise agreed upon in writing by both parties.

For Pregnancy or Medical suspensions:

No fee shall apply.

If you apply for a medical or pregnancy suspension, you are required to provide a valid medical certificate that contains the date, your name, diagnosis, and the doctor's advice.

IKIGAI reserves every right to reject your suspension if the medical certificate is not deemed significant.

You may suspend your Membership for a maximum of twelve (12) months if you are pregnant or for valid medical reasons.

For Non-pregnancy or Non-medical suspensions:

For all suspensions, the suspension period must be for a minimum of one week and a maximum of one month (one week means 7 full days)

For 12-Month Membership holders

You will be entitled to three (3) suspensions free of charge over the validity of your Minimum Term Commitment.

Further suspensions will be charged $288.

For new Memberships sold from June 5th, 2023 onwards only: After the end of the Minimum Term Commitment (from 13th month onwards), you will be able to enjoy 1 x membership suspension free of charge every 6 months. This free suspension cannot roll over if it is unused during the 6-month period.

For 6-Month Membership holders

You will be entitled to two (2) suspensions free of charge over the validity of your Minimum Term Commitment.

Further suspensions will be charged $288

For new Memberships sold from June 5th, 2023 onwards only: After the end of the Minimum Term Commitment (7th month onwards), you will be able to enjoy 1 x membership suspension free of charge every 6 months. This free suspension cannot roll over if it is unused during the 6-month period.

For prepaid Class Package

You will be entitled to one (1) suspension free of charge over the validity of your membership.

Further suspensions will be charged $288

*ALL discounted class packages cannot be extended


For Monthly Membership holders, if your payment date is on the 10th day of the month, please make sure you notify us before the 1st day of the month (10 days prior notice) for your suspension to be effective.

E.g. If your autopay is on 25th Feb, please let us know before 15th Feb.

For prepaid Class Package holders, please take note of your package validity as we can only extend packages that are still active.

Terms applicable to all suspensions:

• Suspension fee is non-refundable and non-transferable.

• No backdated suspensions are allowed.

• Please note that once a suspension has been approved and set by IKIGAI, it cannot be undone.

• If you have a Monthly Committed Autopay, please note that your Autopay will resume automatically without prior notice once your suspension period has ended.

• If you have a Monthly Committed Autopay or Prepaid Class package, the package expiry date will be extended by the number of days/month (s) suspended.

• IKIGAI reserves every right to reject any suspension request at its discretion.

• IKIGAI reserves every right to change the Terms & Conditions from time to time without prior notice.

CLIENTS AND/OR MEMBERS AND/OR GUESTS

The following terms, conditions and policies apply to anyone Clients (Members) and/or Guests, which hereafter may be referred to as “Clients” or Guests who purchases, is gifted or has authorized right to utilize, including but not limited to; any single class, series of classes, package of classes or monthly recurring classes from IKIGAI, which hereafter be referred to as “the Studio”.

ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Your Account access, purchases and continued use is conditional to additional terms and conditions shown and available by point of sale website hyperlink and/or email, text or app access.

By using the Site, you represent and warrant that you are at least 18 years of age and that you agree to abide by all the Terms. Any use by anyone under the age of 18 is prohibited and violates the Terms of Service.

ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

Personal Data Collected


IKIGAI collects different information in order to help us improve the services and products we offer; and to provide unique personalized services and products to each registrant.



IKIGAI collects information on you when you enter a user agreement with IKIGAI and when you register with the IKIGAI website and IKIGAI App.



You are under no obligation to provide your complete personal data. However, the minimum information we require for us to be able to provide you with our products and services are your full name, phone number, and e-mail address.



IKIGAI may also ask for further information from you in order to obtain a better understanding of how IKIGAI can provide personalised services to you, in all instances it is entirely your choice whether or not to provide information, in some cases for us to provide the service requested, you will be required to give certain information, whether you do or not is your choice.

Obviously if you do not, then we may not be able to provide the services requested, in all cases when you are required to give information we will inform you. We will inform you in cases when it is obligatory for you to provide information before you can receive the service requested.

• What year(s) you may have joint IKIGAI;

• How you heard of IKIGAI;

• Community discussions, correspondence through our sites and correspondence sent to us;

• To process your contract renewal and upgrade;
